Inheritance Settlement

About inheritance settlement

Appropriate inheritance procedures must be completed in order to inherit assets including property, bank accounts, and securities. Certain submissions must be made according to Japanese inheritance law, and there are strict deadlines for filings such as inheritance tax.

Inheritance procedures can be meticulous, time consuming, and difficult for non-experts. Multiple government entities and institutions need to be contacted, including tax office(s), legal affairs bureau(s), and financial institution(s). Each institution has its own set of procedures and required documents to submit.

Will Creation

About will creation

We strongly recommend creating a notarized will if you’re considering leaving behind a last will and testament in Japan.

There are various advantages to a notarized will, as it enables a fast-tracked inheritance process that allows heirs to skip time consuming procedures, such as needing to certify a regular will or create an agreement on division of inherited property.

If there is no will at the time of inheritance, division of inheritance among heirs is possible through statutory inheritance or agreement on division of inherited property. However, in some cases it may not be easy to come to an agreement, which can cause unnecessary stress and sometimes even lead to legal disputes among heirs.

We strongly recommend creating a notarized will to avoid such headaches.

Our strengths

STK Legal knows how to create an effective will because we are specialists in inheritance procedures. Our experience is deep and diverse, whether you or your heirs are Japanese or foreign nationals of any nationality. We have partnerships with most major financial institutions, as well as other professional advisors including lawyers and tax accountants. Even if heir(s) reside overseas and/or include foreign national(s), we can help you create a will that accurately conveys your wishes.

Leaving a notarized will is complex because it requires cooperation with a Japanese public notary. Because of our network with notary offices, we can help you benefit from creating a notarized will, while also making sure that your intentions are fully conveyed no matter how complex.

With a well-crafted and valid notarized will, you can ensure a smooth transition of your legacy.
